What is the certificate?

After the presentation of the ITE report together with the request for the aptitude certificate, the administration validates the report by issuing a certificate of aptitude.

It is the document issued by the Generalitat as a positive response to the technical report on the building . Obtaining the Certificat d’Aptitud is the objective of the owner of the building, because it means that the building is in more or less good condition.

The aptitude certificate accredits the state of conservation of the building and qualifies its functional aptitude depending on the qualification that has been done in the ITE and following this classification:

  1. “apt” when the ITE report has found that the building has no deficiencies.
  2. “apt” when in the ITE report it has been detected that the building only has slight deficiencies.
  3. “provisional apt” when the ITE report has detected that the building has significant deficiencies.
  4. “precautionary fit” when the ITE report has detected that the building has serious or very serious deficiencies, but that risk situations have been avoided with the application of precautionary measures.
  5. “resolution denial of aptitude” in case the precautionary measures have not been executed and there are serious or very serious deficiencies. In this case, another request and a new ITE will have to be submitted proving that the precautionary measures or repair works have been carried out.

The certificate of aptitude granted determines that the building is suitable to be used as a home, however a curious thing happens in the decree, in article 12 chapter 3 it is specified that in cases of “provisional apt” with significant deficiencies or “apt precautionary “with serious deficiencies etc the property will be complying with the duty of conservation of the building (until the necessary works are not carried out)

Who grants the certificate of aptitude?

Usually the Generalitat. Logically, the decree that regulates the ITE is regional and the The competent body for granting the certificate is the Generalitat through the Agència de l’Habitatge de Catalunya . But the decree opens the possibility that this competence is transferred to local administrations.

When will I have to renew the certificate of aptitude?

This depends on the state of conservation of the building certified in the certificate of aptitude:

  1. 10 years in the case of a certificate of aptitude “apt”
  2. 10 years in case of aptitude certificate “fit” with slight deficiencies
  3. 6 years in the case of a certificate of aptitude “provisional fit” when the ITE report has detected that the building has significant deficiencies.
  4. 3 years in the case of a certificate of aptitude “provisionally suitable” with serious or very serious deficiencies (the precautionary measures have been executed)
